Terms of Service — BhaiFinder

These Terms of Service ("Terms") govern your use of BhaiFinder (the "App"), the website at bhaifinder.com (the "Website"), and all related services (collectively, the "Service"), operated by BharatAI Solutions Private Limited ("Company", "we", "us", or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. About BhaiFinder

BhaiFinder is an AI-powered personal memory app. You share content (links, photos, videos, visiting cards, text, PDFs) with BhaiFinder via the OS share sheet or within the app. Our AI automatically categorises, tags, and contextualises what you save, and makes it findable via natural language search. You can also set persistent reminders tied to your saved items.

BhaiFinder is a product of BharatAI Solutions Private Limited, incorporated in India.

2. Eligibility

You must be at least 13 years old (16 in the EU) to use BhaiFinder. By using the Service, you confirm that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

3. Your Account

3.1 Registration

You may sign up with your email address or via Google or Apple Sign-In. You are responsible for providing accurate information and keeping your login credentials secure.

3.2 Account security

You are responsible for all activity that occurs under your account. Notify us immediately at hello@bhaifinder.com if you suspect unauthorised access.

3.3 One account per person

BhaiFinder accounts are for individual personal use. You may not share your account credentials with others.

3.4 Account termination by you

You may delete your account at any time from the app (Profile → Settings → Delete Account). See Section 10 for what happens to your data.

4. Acceptable Use

You agree to use BhaiFinder only for lawful, personal purposes. You agree not to:

Use the Service to save, store, or distribute content that is illegal, defamatory, obscene, harmful, threatening, abusive, or violates the rights of any third party
Upload or share content that infringes any copyright, trademark, patent, trade secret, or other intellectual property right
Attempt to gain unauthorised access to our systems, servers, databases, or other users' accounts
Use automated tools (bots, scrapers, crawlers) to access the Service
Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the app
Use the Service in any way that could damage, disable, overburden, or impair our infrastructure
Circumvent or attempt to circumvent any quota, feature gate, or subscription enforcement mechanism
Use the Service for commercial purposes (e.g. reselling, whitelabelling) without our written permission
Impersonate any person or entity or misrepresent your affiliation with any person or entity

We reserve the right to suspend or terminate your account immediately if you violate these terms.

5. Content You Save

5.1 Your content, your responsibility

You retain full ownership of the content you save. By saving content to BhaiFinder, you grant BharatAI Solutions Private Limited a limited, non-exclusive, royalty-free licence to store, process, and display that content solely to provide the Service to you.

5.2 We do not claim ownership

We will never claim ownership over your saved content.

5.3 Your responsibility for saved content

You are solely responsible for ensuring that the content you save complies with applicable laws and does not infringe third-party rights. We are not responsible for the content you save.

5.4 Content shared with AI

When you save content, it is processed by AI (Anthropic Claude Haiku) for categorisation and context extraction. We transmit the content of what you saved to Anthropic's API for this purpose. Please do not save content that contains highly sensitive personal information (e.g. passwords, Aadhaar numbers, financial account details) as such content may be processed by AI systems.

6. Plans and Payments

6.1 Free plan

BhaiFinder offers a Free Bhai plan at no charge, subject to usage limits (20 saves per month, 10 AI-parsed saves, 3 active reminders). Limits reset every Monday.

6.2 Paid plans

Bhai Pro: ₹99/month or ₹899/year
Bhai Pro Max: ₹199/month or ₹1,799/year

6.3 Payment processing

Payments are processed by Razorpay. By subscribing, you also agree to Razorpay's terms of service. We support UPI, credit/debit cards, net banking, and wallets.

6.4 Subscription renewal

Subscriptions renew automatically at the end of each billing period. You will be charged the applicable amount unless you cancel before the renewal date.

6.5 GST

All prices are inclusive of 18% GST for Indian users. GST invoices are available on request. If you require a GST invoice, provide your GSTIN to hello@bhaifinder.com.

6.6 Price changes

We may change subscription prices. We will provide at least 30 days' notice before any price increase affects your existing subscription.

6.7 Cancellation

You may cancel your subscription at any time from within the app (Profile → My Plan → Cancel Subscription). Cancellation takes effect at the end of your current billing period — you retain access to paid features until then.

6.8 Refunds

See our Refund Policy for full details. In summary: we offer a 7-day refund for first-time subscribers where the service was not usable due to a technical fault on our side. We do not issue refunds for change of mind.

7. Intellectual Property

7.1 Our IP

The BhaiFinder name, logo, mascot ("Bhai"), app design, codebase, and all content we produce are the property of BharatAI Solutions Private Limited and are protected by Indian and international intellectual property laws.

7.2 Mascot

The "Bhai" mascot is original IP belonging to BharatAI Solutions Private Limited. You may not reproduce, modify, or use the Bhai mascot for any purpose without our written permission.

7.3 Restrictions

You may not copy, modify, distribute, sell, or lease any part of our Service, or reverse-engineer or attempt to extract the source code of the app.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available." To the maximum extent permitted by applicable law, BharatAI Solutions Private Limited disclaims all warranties, express or implied, including:

Warranties of merchantability, fitness for a particular purpose, and non-infringement
That the Service will be uninterrupted, error-free, or free of viruses
That the AI categorisation and context extraction will always be accurate
That saved content will never be lost (we maintain backups, but you should not rely on BhaiFinder as your only backup)

9. Limitation of Liability

To the maximum extent permitted by applicable law, BharatAI Solutions Private Limited shall not be liable for:

Loss of data, saved content, or reminders
Indirect, incidental, special, consequential, or punitive damages
Any damages arising from your use or inability to use the Service
Any inaccuracy in AI-generated categorisation or context

Our total liability to you for any claim arising out of or related to the Service shall not exceed the amount you paid us in the 3 months preceding the claim (or ₹500, whichever is greater).

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud.

10. Account Deletion and Data

When you delete your account:

A 30-day grace period begins, during which you can recover your account by logging back in
After 30 days, your account, saved items, categories, and reminders are permanently and irreversibly deleted
Subscription records and payment logs may be retained for 7 years for tax compliance
If you have an active paid subscription, it will be cancelled, and you will retain access until the end of the billing period

To request account deletion: go to Profile → Settings → Delete Account, or email hello@bhaifinder.com.

11. Termination by Us

We may suspend or terminate your account if you:

Violate these Terms or our Acceptable Use Policy
Engage in fraudulent activity
Use the Service in a way that harms other users or our systems

We will give you reasonable notice before termination unless your actions require immediate action (e.g. suspected fraud, illegal activity). Upon termination, your right to use the Service ceases immediately.

12. Third-Party Services

BhaiFinder integrates with third-party services including Anthropic (AI), Google (Firebase, ML Kit, Sign-In), Apple (Sign-In), Razorpay (payments), and AWS (storage). Your use of these integrations is also subject to those providers' terms of service. We are not responsible for the acts or omissions of these third parties.

13. Changes to These Terms

We may update these Terms. When we do, we will update the "Last updated" date and notify you via in-app notification or email for material changes. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation by emailing hello@bhaifinder.com. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts in India.

For EU users: nothing in this section limits your rights under applicable EU consumer protection law.
