EULA — End User Licence Agreement

This End User Licence Agreement ("EULA") is a legal agreement between you ("User", "you") and BharatAI Solutions Private Limited ("Company", "we", "us", or "our"), the developer of the BhaiFinder mobile application ("App").

By downloading, installing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree, do not download or use the App.

1. Licence Grant

Subject to your compliance with this EULA and our Terms of Service, BharatAI Solutions Private Limited grants you a limited, non-exclusive, non-transferable, revocable licence to:

Download and install the App on devices you own or control
Use the App for your personal, non-commercial purposes

This licence does not include any right to sublicence, sell, resell, transfer, assign, or commercially exploit the App.

2. Licence Restrictions

You agree not to:

Copy, modify, adapt, translate, reverse-engineer, disassemble, decompile, or create derivative works based on the App or any part of it
Remove, obscure, or alter any copyright, trademark, or other proprietary rights notice from the App
Use the App in any manner not expressly permitted by this EULA
Circumvent or disable any security, digital rights management, or feature restriction mechanisms in the App
Use the App to develop a competing product or service

3. Ownership

The App, including all intellectual property rights in it (source code, object code, interface, content, design, trademarks, mascot "Bhai", and all other elements), is and remains the exclusive property of BharatAI Solutions Private Limited. This EULA grants you a licence to use the App — it does not transfer any ownership to you.

4. Third-Party Components

The App incorporates the following third-party services. Your use of the App is also subject to their terms:

5. App Store Terms (Apple)

If you downloaded the App from the Apple App Store, the following additional terms apply:

This EULA is between you and BharatAI Solutions Private Limited only — not Apple Inc. ("Apple").
Apple is not responsible for the App or its content.
Apple has no obligation to provide any maintenance or support for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims by you or any third party relating to the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
If a third party claims that the App or your possession and use of the App infringes that third party's intellectual property rights, Apple will not be responsible for the investigation, defence, settlement, or discharge of such a claim.
Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
You must comply with applicable third-party terms of service when using the App (e.g. not violating wireless data service agreements).
The App is not intended for use in situations where failure of the App could lead to death, personal injury, or severe physical or environmental damage.

6. App Store Terms (Google Play)

If you downloaded the App from the Google Play Store:

This EULA is between you and BharatAI Solutions Private Limited only — not Google LLC ("Google").
Google is not a party to this EULA and bears no responsibility for the App.
You must comply with Google Play's Terms of Service in your use of the App.

7. Subscription and In-App Purchases

The App offers paid subscription plans (Bhai Pro, Bhai Pro Max) processed through Razorpay (not through Apple or Google IAP). Subscription terms, pricing, and refund eligibility are described in our Terms of Service and Refund Policy at bhaifinder.com/refund.

8. Updates and Maintenance

We may release updates to the App from time to time. Updates may be required to continue using the App. We are not obligated to provide any specific updates or to maintain any specific version of the App indefinitely.

9. Termination

This licence is effective until terminated. It will terminate automatically if you breach any term of this EULA. Upon termination, you must cease all use of the App and delete it from your devices. Sections 3, 9, 10, 11, and 12 survive termination.

We may also terminate this licence if we discontinue the App. We will provide reasonable notice of discontinuation where possible.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. BHARATAI SOLUTIONS PRIVATE LIMITED EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BHARATAI SOLUTIONS PRIVATE LIMITED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM (OR ₹500, WHICHEVER IS GREATER).

NOTHING IN THIS EULA EXCLUDES LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, OR FOR FRAUD OR FRAUDULENT MISREPRESENTATION.

12. Governing Law

This EULA is governed by the laws of India. Any disputes shall be resolved under Indian law, subject to the courts of India having exclusive jurisdiction.

For EU residents: nothing herein limits your statutory rights under EU consumer protection law.
